Welcome to Anastomix.ai, a platform provided by Cheetahs Deliver Pty Ltd (“Anastomix,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of the Anastomix.ai website, web application, mobile applications (if any), and all associated services (collectively, the “Platform”). Please read these Terms carefully before using the Platform. By accessing or using the Platform, you (“User,” “you,” or “your”) agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not access or use the Platform.

1. Acceptance of Terms
1.1 Agreement. By creating an account, uploading content, or otherwise using the Platform, you confirm that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy.
1.2 Eligibility. You represent and warrant that you are at least 18 years of age or the age of majority in your jurisdiction, whichever is higher. If you do not meet these requirements, you must not use the Platform.

2. Description of Services
2.1 Platform Overview Anastomix.ai is an AI-driven platform that facilitates the sharing of medical questions, problems, and supporting documents (such as medical imaging, blood tests, and patient histories). Verified specialists (“Specialists”) may provide comments, insights, or recommendations, offering multiple second opinions to Users. 2.2 AI Assistance The Platform employs AI (including both in-house systems and third-party AI services) to classify, analyze, and suggest next steps or clarifications for Users. The goal is to streamline information-sharing and enhance the accuracy of specialist feedback.
2.3 AI-Powered Personalized Health Roadmap Anastomix.ai provides an AI-powered personalized Health Roadmap by analyzing all available materials—such as your personal descriptions of symptoms, medical records, laboratory tests, imaging data, and specialist feedback. This Roadmap offers a customized overview of potential next steps in your healthcare journey, helping you to better understand, organize, and manage your condition.
2.4 Continuous Record-Keeping Users may update their medical profiles over time by uploading new documents (e.g., follow-up tests, new reports). This enables Specialists and the AI systems to have a broader perspective when providing feedback, ensuring the personalized Health Roadmap remains as accurate and relevant as possible.

3. User Responsibilities
3.1 Accuracy of Information. You are solely responsible for all information you submit or upload, including medical records, images, and personal details. You agree that all information provided is accurate, complete, and up-to-date.
3.2 Removal of Identifiers. We strongly recommend removing personal identifiers (e.g., full legal names, addresses) from all documents and images before uploading. While Anastomix employs pseudonymization where feasible, complete anonymity cannot be guaranteed.
3.3 Compliance with Laws. You agree to use the Platform only in compliance with applicable laws and regulations. You must not upload any material that is false, fraudulent, infringing, or otherwise violates the rights of third parties.
3.4 Security of Credentials. You are responsible for maintaining the confidentiality of your account credentials. Any activity under your account is presumed to be yours, and you should notify us immediately of any unauthorized use of your account.

4. Data Privacy and Security
4.1 Pseudonymization. We use pseudonymization techniques to replace personally identifiable information with artificial identifiers. However, the process is not foolproof, and absolute anonymity cannot be guaranteed.
4.2 Data Usage for AI Training.
• By default, your data—including medical history, comments, and recommendations—may be used to train our AI models after being fully anonymized to the best of our abilities.
• Opt-Out: You may choose to opt out of data usage for AI training by adjusting your account settings. Please be aware that opting out may limit certain functionalities of the Platform.
4.3 Third-Party AI Services.
• Your data, including medical documents, may be processed by our AI systems and third-party AI services (e.g., OpenAI, Google Gemini, Anthropic).
• These third-party services have their own terms and privacy policies. By using the Platform, you acknowledge that your anonymized data may be processed under those separate terms. We encourage you to review their policies.
4.4 Data Security.
• We employ industry-standard security measures to protect your data from unauthorized access, disclosure, or misuse.
• Despite our efforts, no method of data transmission or storage is 100% secure. We do not warrant or guarantee the absolute security of your data.

5. Anonymity of Specialists
5.1 Specialist Profiles. Specialists (e.g., doctors) on the Platform are verified by Anastomix. Some Specialists may choose to appear under a fictional name to minimize potential biases and preserve privacy. In such cases, their credentials have been duly verified by Anastomix.
5.2 Revealing Identities. Real identities of Patients and Specialists will only be disclosed if both parties agree, typically when a personal online meeting or extended consultation is booked.

6. Use of AI Systems
6.1 AI Assistance. Our AI tools assist in summarizing, classifying, and organizing your documents for easier specialist review.
6.2 AI Limitations. While we strive to provide accurate and up-to-date AI-driven insights, AI systems are inherently prone to errors. You should independently verify all information and always consult qualified healthcare professionals.

7. Payment and Fees
7.1 Free Services.
• Storage & Tracking: Anastomix is free for storing, organizing, and tracking your medical records. Users can post unlimited documents and updates.
• First Specialist Comment: The initial comment from a Specialist is unlocked for free.
7.2 AI-Powered Personalized Health Roadmap. Users are charged a fee for each personalized health roadmap generated by our AI service. The price will be displayed prior to purchase.
7.3 Additional Specialist Feedback. Additional comments, recommendations, or extended Specialist feedback require payment. Pricing will be disclosed before you finalize your purchase.
7.4 No Feedback, No Charge. You will not be charged if you do not receive Specialist feedback.
7.5 Payment Processing. Payment may be processed through third-party payment gateways. You agree to provide accurate payment information and understand that any issues with payment services are subject to the terms and conditions of those third-party providers.

8. No Medical Diagnosis
8.1 Information-Only Platform.
• Not a Diagnostic Tool: Anastomix.ai is not a substitute for professional medical diagnosis, treatment, or advice. All content, including AI recommendations and Specialist comments, is provided for informational purposes only and may contain inaccuracies.
• Professional Consultation: Always seek the guidance of your physician or other qualified health provider with any questions regarding a medical condition.
8.2 No Doctor-Patient Relationship. Use of the Platform, including interactions with Specialists, does not create a formal doctor-patient relationship. Your final healthcare decisions should be made in consultation with licensed healthcare professionals.
8.3 Emergency Situations. The Platform is not intended for emergency medical situations. If you believe you have a medical emergency, call emergency services in your area or seek immediate professional care.

9. Intellectual Property Rights
9.1 Ownership. All content on the Platform—including text, graphics, logos, icons, and software—belongs to Anastomix or its content suppliers and is protected by intellectual property laws.
9.2 User License. By submitting content to the Platform, you grant Anastomix a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your submitted content in connection with providing, improving, and promoting the Platform.
9.3 User Warranties. You warrant that you own or have the necessary rights to the content you submit and that your submission does not violate any law or infringe any third-party rights.

10. Limitation of Liability
10.1 No Warranties. The Platform is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Anastomix disclaims all warranties, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10.2 Limitation of Damages. In no event will Anastomix, its affiliates, officers, directors, employees, or agents be liable to you or any third party for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, or goodwill) arising from or related to your use of the Platform.
10.3 Maximum Liability. To the extent permitted by law, Anastomix’s total liability to you for all claims arising out of or relating to these Terms or your use of the Platform shall be limited to the amounts paid by you to Anastomix in the twelve (12) months preceding the event giving rise to the claim.

11. Indemnification
You agree to indemnify, defend, and hold harmless Anastomix and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, and expenses (including legal fees) arising out of or related to: (a) your use or misuse of the Platform; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any content you submit to the Platform.

12. Modifications to the Terms
12.1 Right to Modify. We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting the revised Terms on the Platform. Your continued use of the Platform following the posting of revised Terms means that you accept and agree to the changes.
12.2 Notification. We may, but are not obligated to, provide additional notice (such as email or a banner notice on the Platform) in the event of material changes to these Terms.

13. Termination
13.1 Termination by Anastomix. We may suspend or terminate your access to the Platform at our sole discretion, with or without prior notice, for any reason, including breach of these Terms.
13.2 Effect of Termination. Upon termination, your right to use the Platform immediately ceases. Any provisions of these Terms that by their nature should survive termination (e.g., indemnities, limitation of liability, intellectual property, disclaimers) shall survive.

14. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect. Any invalid or unenforceable provision will be interpreted to give effect to the parties’ intent as closely as possible.

15. Entire Agreement
These Terms and the Privacy Policy constitute the entire agreement between you and Anastomix regarding your use of the Platform and supersede any prior agreements, communications, or understandings, whether written or oral.

16. Governing Law and Dispute Resolution
16.1 Governing Law. These Terms and any dispute arising out of or relating to them will be governed by and construed in accordance with the laws of the jurisdiction where Cheetahs Deliver Pty Ltd is registered, without regard to its conflict of law provisions.
16.2 Dispute Resolution. Any dispute, controversy, or claim arising out of or relating to these Terms will be resolved through good-faith negotiations. If negotiations fail, the dispute may be resolved by a competent court in the jurisdiction where Cheetahs Deliver Pty Ltd is registered or, at Anastomix’s option, by binding arbitration in that jurisdiction.
